Terms & Conditions

These Terms & Conditions ("Terms") are a legal agreement between you and Blizzard Delights, LLC, a California limited liability company ("Blizzard Delights," "we," "our," or "us"), and govern your access to and use of our website at blizzarddelights.com, our products and services, and our SMS messaging program. By accessing or using any of the foregoing, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Services

Blizzard Delights provides software-as-a-service products including, but not limited to, SongMix, Owaa, and our Shopify applications (AI Virtual Try-On, Dynamic Pricing by AI, OmniRep, and ShopReel) (collectively, the "Services"). Each Service may have additional product-specific terms presented at sign-up or install, which are incorporated into these Terms by reference.

2. Accounts and eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use paid Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• We may suspend or terminate accounts that violate these Terms or that appear to be fraudulent, abusive, or harmful to other users.

3. Acceptable use

You agree not to:

• Use the Services to violate any applicable law or regulation.
• Upload, generate, or distribute content that is illegal, infringing, defamatory, obscene, or harmful.
• Attempt to gain unauthorized access to the Services, other accounts, or our infrastructure.
• Reverse engineer, decompile, or otherwise attempt to extract source code, except to the extent permitted by law.
• Use the Services to send spam, phishing, or other unsolicited communications.
• Resell, sublicense, or redistribute the Services without our prior written consent.
• Use outputs of our AI Services to train competing AI models without our consent.

4. User content and AI outputs

You retain ownership of content you submit to the Services ("User Content"). You grant Blizzard Delights a worldwide, royalty-free license to host, process, and display User Content solely to operate and improve the Services on your behalf.

Outputs generated by our AI Services (for example, music tracks from SongMix or video ads from ShopReel) are provided to you subject to applicable Service-specific terms. You are responsible for ensuring that your use of AI outputs complies with applicable law, including intellectual property, publicity, and advertising rules.

5. Subscriptions, billing, and refunds

• Paid Services are billed in advance on a recurring basis (monthly or annual) unless otherwise stated.
• You authorize us (or our payment processor) to charge your payment method at the start of each billing cycle.
• Subscription fees are non-refundable except as required by law or as expressly stated in product-specific terms.
• We may change prices on notice at least 30 days in advance; new prices take effect at the next renewal.
• You may cancel at any time; cancellation takes effect at the end of the current billing cycle.

The Services may integrate with third-party platforms, including Shopify, Twilio, Stripe, Cloudflare, and various AI model providers. Your use of those third parties is subject to their own terms and privacy policies. Blizzard Delights is not responsible for third-party services.

8. Intellectual property

All rights, title, and interest in and to the Services (excluding User Content and AI outputs) — including all software, trademarks, and documentation — are and remain the exclusive property of Blizzard Delights or its licensors. No rights are granted to you other than the limited right to use the Services in accordance with these Terms.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR REQUIREMENTS OR BE ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLIZZARD DELIGHTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Blizzard Delights from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third party's rights.

12. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms, non-payment, or at our reasonable discretion. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including Sections 8–11, 13, and 14) will survive.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, excluding its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. We will post updated Terms on this page and update the "Last updated" date. Material changes will be communicated by email or in-product notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
